Online Wine Sales: Terms and Conditions

• Legal age:

  By accessing this website and/or the content thereof you represent and warrant that you are of the full legal age, being 18 years or older in South Africa, to purchase the alcoholic beverages sold on the website. Should you purchase any wines through us through this website, the person receiving delivery of such wines may be required to show identification proving that he or she is of the applicable legal age.

• Credit Card Security and Privacy

  We understand the importance of your privacy and security. We are committed to protecting the information we collect from you and confirm that it will only be used for purposes of processing your order and providing you with the services you request from usThe private information required for executing the order placed through the website, namely your personal information, credit card details, delivery address and telephone numbers will be kept in the strictest confidence by us and not sold or made known to third parties.

• Wine sales and Stock Availability

  All the wines displayed on our website are subject to availability. Sometimes we may be out of stock of certain wines. Should this happen we will contact you to suggest an alternative wine at the same price. If we are unable to supply each and every item ordered or in the quantities ordered, you nevertheless agree to accept delivery and make payment for the items correctly delivered. All prices shown on our website are quoted in South African Rands. Prices include Value-Added Tax. Special promotions may be subject to certain conditions, including stock availability and limited offer stipulations. We do, however, reserve the right to discontinue or change the specifications of our wines from time to time without notice, or to adjust our prices in which event you will be informed thereof at the time of receipt of your order.

• Methods of payment

  Payment may be made via Visa, Master Card, Diners or American Express credit cards, debit or electronic transfers.

• Confirmation of orders

  Orders placed online constitute your offer to purchase subject to these Terms and Conditions. Your offer is deemed to have been accepted by us when you receive our confirmation of your order. Failure by us to formally confirm or notify acceptance shall not affect the validity of the sale or the enforceability thereof.

• Delivery

  Unless specifically quoted otherwise, a delivery fee will be charged for each order placed by you. Wine purchased will only be dispatched upon successful receipt of payment. Delivery will be made to the address on your application form, which usually takes place 5-10 working days from payment. All deliveries made in South Africa will be by road freight directly to your nominated delivery address. All goods must be signed for on delivery. If no one is available at the nominated address when delivery is attempted, the goods will be retained by the courier, in which case notification of the attempted delivery will be given. Should the wine order be returned to Fairview, any further delivery attempts will be at your cost. We will not be liable for any loss occasioned by any delay in the delivery of any order, nor for any loss, damage or misplacement of any wines ordered from us after delivery has been made to your nominated delivery address. Products are only insured up to the point of delivery. Risk in and to the products will transfer to you upon completion of delivery.

• Cancellation

  An order is considered cancelled once you have notified Fairview and we have communicated to you confirmation of receipt of your cancellation notice. Cancelled orders from the website facility will be refunded after deduction of a 10% charge for administration costs. Orders may be cancelled by calling us on ••• or by e-mail via •••. You will only be able to cancel orders up to midnight on the day prior to the date of delivery. We reserve the right to debit your payment card for the delivery fees in respect of any late cancellations.

• Returns

  Fairview aims to ensure quality of all the products supplied. If for any reason you are dissatisfied with your order and the quality of our products, please contact us and return the items at your cost within fourteen (14) days of delivery of your order. If we find that the items were faulty in any respect when delivered to you, we will refund you the price of the items, as well as the cost of delivery to return the items to Fairview. This will be undertaken within thirty (30) days of our receipt of the returned items. You will be deemed to have accepted the order should you not return the products within the fourteen (14) day period.

• Jurisdiction:

  These terms of use shall be solely and exclusively governed by and construed and interpreted in accordance with the law of Republic of South Africa. The parties agree that the agreement shall, for purposes of jurisdiction, have been concluded at our office in Paarl.
